Administrative and constitutional law
The Constitution is a living, breathing document that represents the nation's aspirations and is divided into chapters detailing the manner, form, and extent to which the sovereign power of the State and government is exercised.

The Constitution of Guyana, our supreme law, guarantees the protection of fundamental rights and freedoms of the individual against the State and grants original jurisdiction to the High Court of the Supreme Court to secure the enforcement and protection of these fundamental rights and freedoms.

Administrative law concerns the High Court’s regulation of decisions and omissions made by public authorities, including determining whether these authorities exercised their statutory and constitutional powers in accordance with the law.

A few of our cases

  • Doreen Monah v Attorney General and Mahaica Mahaicony Abary Agriculural Development Authority (unreported) 2018-HC-DEM-CIV-FDA-135- The High Court of the Supreme Court granted declarations that the decision of the Mahaica Mahaicony Abary Agriculural Development Authority made in 2018, cancelling and revoking the Applicant’s long lease, infringed her fundamental right not to be deprived of her property.

  • Tularam Ramassar v Attorney General (unreported) 2017-HC-DEM-CIV-SOC-108-The High Court of the Supreme Court ruled that the Applicant’s detention by the Guyana Police Force was unlawful, illegal, and in breach of his fundamental right not to be deprived of her personal liberty. The Applicant was awarded two million dollars ($2,000,000) as compensation

  • Sleep-In International Hotel and Casino Inc v Gaming Authority- The High Court granted an order of mandamus directing and compelling the Gaming Authority to process, consider, and determine applications by the Applicant for a casino premises licence and a casino operator’s licence.

  • Application by Mowini Persaud- The High Court of the Supreme Court quashed the Applicant’s conviction on the ground that the Magistrate lacked jurisdiction to hear and determine the complaint filed against her at the time that the charged was instituted.

Defamation

The Supreme Law of Guyana guarantees to every citizen the fundamental freedom of expression, including the freedom to communicate ideas and information without interference, subject to the protection of reputations, rights and freedoms of others. It is the protection of reputations that is central to the law of defamation, and the methods of protection deployed by the Courts include the grant of injunctions and monetary compensation against the tortfeasor.

  • Mohabir Anil Nandlall v Basil Williams.

  • Clifton Bacchus v Guyana National Newspapers and the Editor of the Guyana Chronicle.

Land law

Guyana’s unique hybrid legal system, comprising civil law and common law, is exemplified by our land law, where Roman-Dutch law and English common law coexist.

Our firm has successfully obtained orders of court upholding the validity of titles and transports and have also obtained orders setting aside transports obtained by fraud committed and perpetuated by the person whose transport was set aside.

Non-contentious practice

Probate and Administration

A deceased person remains the owner of property after their death, and their property is held by their estate until their executor or administrator, whether by a Last Will and Testament or under the rules of intestacy, applies for and obtains a Grant of Probate or Letters of Administration for the estate of the deceased.

Grants of Probate and Letters of Administration lawfully authorise the executor or administrator of the deceased person to transfer and vest the deceased person’s property to the beneficiaries.

Companies

Guyana’s Companies Act 1991 governs the incorporation, operation and regulation of Guyanese companies and the registration and operation of external companies in Guyana.
